Understanding Cyber Security Under the Lens of the New USCG NVIC 01-20

The U.S. Coast Guard (USCG) has issued the Navigation and Vessel Inspection Circular (NVIC) 01-20 announcing the agency's position on cybersecurity and cyber risk management controls for maritime facilities regulated under the 33 CFR 105 code of federal regulations – Maritime Transportation Security Act (MTSA) regulated facilities.

ABS Group has a longstanding relationship working closely with USCG to support safety and risk management in the maritime industry. Our Cybersecurity team developed the first training course for facility security officers outlining the National Institute of Standards and Technology (NIST) Cybersecurity Framework in accordance with USCG recommendations. Presenters

Captain Dave Nichols

Captain Dave Nichols, USCG (ret.) is Business Development Director for Marine and Offshore at ABS Group. He is responsible for the development and delivery of cybersecurity services for maritime ports and terminals worldwide.

Captain Nichols joined ABS in June of 2018 after a 26-year U.S. Coast Guard career that culminated in his position as Chief of the Outer Continental Shelf Division overseeing all oil and gas drilling and production activities in the U.S. Gulf of Mexico. Prior to that, he served in a number of marine safety positions, including Chief of Port Operations, Commercial Vessel Inspector and Staff Judge Advocate. Most notably, Captain Nichols served as the Chief of Staff and Principal Legal Advisor to the Federal On Scene Coordinator during the Deepwater Horizon fire, explosion and pollution response. He currently serves as the Vice Chair of the Gulf of Mexico Area Maritime Security Committee.

Captain Nichols received his Bachelor's degree in communication from the University of Texas at Austin and graduated cum laude from Tulane Law School in 2000 with an Admiralty Certificate. He is a member of the State Bar of Texas and the U. S. Supreme Court Bar.

Brian A. Shajari

Brian is a Senior Cybersecurity Assessor at ABS Group Cybersecurity team and specializes in vessel/port cybersecurity and physical security, working with clients, Coast Guard partners and other government agencies to implement cybersecurity best practices and policies that affect MTSA-regulated facilities.

With over 18 years of professional experience in the intelligence, MTSA security and cybersecurity fields, his areas of expertise include compliance with existing regulations outlined in 33 CFR (Subchapter H), industrial control systems security, authoring and enforcing cybersecurity policies, and contingency planning. As an intelligence professional and veteran of the active component of the U.S. Coast Guard, he has worked in various intelligence disciplines allowing him to leverage this experience as an effective facility and vessel cybersecurity assessor. He has also served as an FSO at a MTSA-regulated facility, allowing him to combine both physical and cybersecurity standards into daily security practices.  

He is credentialed as a Facility Security Officer. Brian serves on the Southeast Texas Area Maritime Security Committee (AMSC) as the cybersecurity subcommittee chairman, an advisor to the Lamar University Port Management graduate school and is a recognized cybersecurity subject matter expert in the maritime industry throughout the Texas Gulf Coast. He holds a Bachelor of Science in Criminal Justice from Lamar University and a Master's Degree in Cybersecurity from American Military University.
